THIS IS A RELEASE OF LEGAL RIGHTS -PLEASE READ CAREFULLY!

EACH VOLUNTEER MUST SUBMIT THIS FORM IN ORDER TO PARTICIPATE.

I, the undersigned, hereby and forever discharge and hold Walking For Rochester, Inc., its directors, officers, and agents (collectively “Walking For Rochester”), harmless from any and all liability, claims, and demands, either in law or in equity, which arise or may hereafter arise from my participation in group cleanup events, individual cleanup events, or corporate events, whether arising out of the ordinary negligence of Walking For Rochester or otherwise. I understand the risk associated with cleaning up refuse, that it is a potentially dangerous activity, and understand the instructions set forth on what I should and should not clean up. I understand that items that should not be touched include, but are not limited to, broken glass, needles, or bio-waste. I understand that those items should be noted for Walking For Rochester which will refer the noted items to the City of Rochester (311) for disposal.

I fully release and forever discharge Walking For Rochester from any claim whatsoever which arises or may arise hereafter on account of any first aid, treatment, or service rendered in connection with my participation in activities described above. I understand I am not an employee of Walking For Rochester, and agree that I shall not represent myself as such. I will not receive compensation for any services performed and shall not be covered by Workers’ Compensation Laws of the State of New York. I understand that Walking For Rochester does not carry or maintain health, medical, or disability insurance coverage for its volunteers, and that I should obtain my own medical or health insurance coverage. This Waiver shall apply to all activities I perform as a volunteer for Walking For Rochester, no matter when performed.

I also authorize Walking For Rochester to use, reuse, and to grant others the right to use and reuse, my name, photograph, likeness (including caricature) and voice, a and any reproduction or simulation thereof, in any media now known or hereafter developed (including but not limited to film, video and digital or other electronic media), both during and after the my affiliation as a volunteer for Walking For Rochester, for whatever purposes Walking For Rochester deems necessary. I hereby acknowledge that signature of this Waiver will constitute “written consent” for the purposes of Section 50 of the New York Civil Rights Law.

I agree and understand that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of New York, and that this Waiver shall be governed by and interpreted in accordance with the laws of the State of New York. I agree that in the event that any clause or provision of this Waiver shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Waiver which shall continue to be enforceable.

I have read this Waiver thoroughly and fully understand and enter into it on behalf of myself, my heirs, next of kin, assigns, and personal representatives. No one has made any representations, statements, or inducements that change or modify anything written in this Waiver.
